Cadet Athletic Performance LLC ("CAP!", "we", "us", or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and safeguard information when you visit cadetathleticperformance.com, use our mobile app and booking platform, or train with us (collectively, the "Services").

1. Information We Collect

Information you provide:

  • Name, email address, phone number, and billing address

  • Account and booking details (memberships, packages, session history)

  • Payment information (processed by our third-party payment processor; we do not store full card numbers)

  • Emergency contact information

  • Health and athletic assessment information — such as medical disclosures, injuries, limitations, and performance/assessment data collected to deliver safe, individualized training. We treat this as sensitive information.

  • For minors: a child's name, date of birth, and the above categories as relevant, provided by a parent or legal guardian (see §5)

  • Communications you send us (email, text, forms)

Information collected automatically:

  • IP address, browser type, and device information

  • Site and app usage data collected through cookies, analytics, and similar technologies (see §4)

 
2. How We Use Your Information

 

We use information to:

  • Schedule, manage, and deliver training sessions and memberships

  • Design safe, individualized programming based on health and assessment data

  • Process payments and send receipts

  • Send service communications (confirmations, reminders, account notices) and, with your consent or as permitted, promotions and updates

  • Operate, secure, and improve our Services

  • Comply with legal, safety, and contractual obligations

 

We do not sell, rent, or trade your personal information, and we do not sell the personal information of minors.

3. How We Share Information

We share information with trusted service providers who help us operate, only as needed to perform their functions and under confidentiality and security obligations. These include:

  • Exercise.com — booking, scheduling, membership, and program management

  • PaySafe and Stripe — payment processing

  • Mailchimp — email communications

  • Airtable — secure storage of athlete assessment data

  • Meta — advertising and analytics (subject to the minor-data restrictions in §4–§5)

We may also disclose information if required by law, to enforce our agreements, or to protect the rights, property, or safety of our participants, staff, or the public.

 
4. Cookies, Analytics & Advertising

We use cookies and similar technologies to operate the Site, understand usage, and support marketing. This may include advertising and analytics tools such as the Meta pixel.

You can control cookies through your browser settings and opt out of personalized advertising through the ad platforms' own controls (e.g., your Meta ad preferences) and tools like the Digital Advertising Alliance opt-out.

We do not use minors' personal information for targeted advertising, behavioral profiling, or audience modeling, consistent with the New York Child Data Protection Act (see §5).

5. Minors' Privacy
​

CAP! provides training services to youth, so we knowingly collect and process personal information about minors — provided by a parent or legal guardian — for the purpose of delivering those services. We handle minors' data consistent with the federal Children's Online Privacy Protection Act (COPPA) and the New York Child Data Protection Act (CDPA):

  • Children under 13. We collect and process a child's personal information only with verifiable parental consent and only as needed to provide our Services, in accordance with COPPA.

  • Minors aged 13–17. We process personal information only where we have informed consent (from the minor or guardian as applicable) or where processing is strictly necessary to provide the services requested, run our internal operations, ensure security, or meet legal obligations.

  • No sale; no targeted advertising or profiling. We do not sell minors' personal information and do not use it for targeted advertising, behavioral profiling, or audience modeling.

  • Bookings and forms. All bookings, forms, payments, and communications for a minor should be submitted by a parent or legal guardian.

  • Turning 18. When a participant turns 18, protections that applied to data collected while they were a minor continue to apply unless we obtain their informed consent for additional processing.

  • Disposal. We dispose of minors' personal information securely when it is no longer needed for the purposes collected.

If you believe a child's information has been provided to us without appropriate parental involvement, contact info@cadetathleticperformance.com and we will address it promptly.

6. Data Retention
​

We keep personal information for as long as needed to provide the Services, maintain business and financial records, and meet legal obligations — then securely delete or de-identify it. Health, assessment, and minors' data are retained only as long as reasonably necessary for the training relationship and applicable legal requirements. 

 
7. Data Security
​

We maintain reasonable administrative, technical, and physical safeguards to protect personal information, consistent with the New York SHIELD Act (GBL § 899-bb). No system is completely secure, so we cannot guarantee absolute security. In the event of a data breach affecting private information of New York residents, we will provide notice as required by New York law, including within the timeframes the law requires.

 
8. Your Choices and Rights

You may:

  • Access or correct your personal information

  • Request deletion of your personal information, subject to legal and recordkeeping limits

  • Opt out of marketing emails (via the unsubscribe link) and marketing texts (by replying STOP); service-related messages may continue

  • Manage cookie and ad-personalization preferences as described in §4

Our Services may link to third-party websites or platforms. We are not responsible for their privacy practices or content; review their policies directly.

We may update this Privacy Policy from time to time. Updates will be posted here with a revised "Last updated" date and, where appropriate, communicated by email or in-app notice.
